TERMS OF SERVICE

These Terms of Service (“Terms”) constitute a legally binding agreement between the end user (“User” or “You”) and Obsidian (“Company”, “We”, “Us”). By accessing, purchasing, downloading, installing or using any software, key, loader or service provided by Obsidian (collectively, the “Services”), you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.
Definitions
- Services — all digital keys, software loaders, downloadable tools, documentation and website content provided by Obsidian.
- Software — any executable file, loader, configuration, key validation system or digital product sold or distributed by Obsidian.
- User Content — any communication sent through Discord, email or other platforms operated by Obsidian.
- Prohibited Party — any individual or entity prohibited from accessing the Services under the Eligibility section below.
License Grant
Obsidian grants you a revocable, non-exclusive, non-transferable, non-sublicensable license to use the Software solely for personal purposes. This license does not constitute a transfer of intellectual property rights. All rights not expressly granted are reserved by Obsidian. Obsidian may modify, suspend or discontinue the Services at any time with reasonable notice, except in cases of urgent security requirements.
No Warranty of Operation
The Software is provided “as is” and “as available”, to the fullest extent permitted by French law. Obsidian does not guarantee compatibility, uninterrupted operation or availability of any feature, particularly following game updates, anti-cheat updates or operating system modifications. Obsidian is not liable for account bans, suspensions or sanctions imposed by any third-party platform or anti-cheat provider. These provisions do not affect your statutory rights under Articles L.217-3 et seq. of the French Consumer Code regarding the legal guarantee of conformity for digital content.
Eligibility and Prohibited Parties
The following individuals and entities are strictly prohibited from accessing, purchasing or using the Services:
Geographic restrictions
Users domiciled in Sweden or accessing the Services from Swedish IP addresses are not authorized to use or purchase the Services.
Game publisher affiliates
Any employee, contractor, affiliate, consultant or agent of companies related to Facepunch Studios, Embark Studios, Epic Games, Respawn Entertainment / EA, Bohemia Interactive, Behaviour Interactive, Wildlight Entertainment or NetEase Games.
Anti-cheat affiliations
Individuals employed by or affiliated with any anti-cheat solution provider, including but not limited to Easy Anti-Cheat (EAC), BattlEye (BE), Vanguard, Ricochet, FACEIT, Unity Anti-Cheat, or any proprietary anti-cheat technology.
By using the Services, you represent and warrant that you are not a Prohibited Party. Any violation will result in immediate termination without refund.
User Responsibilities
You assume full responsibility for your use of the Software and all consequences thereof. You may not:
- Modify, reverse-engineer or attempt to obtain the source code
- Circumvent security measures
- Share, resell or distribute keys outside of authorized channels
- Use the Software in any unlawful manner
External-Only Functionality
Obsidian software operates exclusively through external overlay interaction and does not access, modify or read game memory. Obsidian does not circumvent anti-cheat systems, secure modules, encryption or protected game binaries. This clause is intentionally included for legal protection under applicable anti-circumvention laws, including the EU Copyright Directive (2001/29/EC) and French intellectual property law (Code de la propriété intellectuelle, Art. L.122-6-1).
Intellectual Property
All intellectual property rights in the Software, including but not limited to source code, object code, algorithms, architecture, user interfaces, documentation and trademarks, are and remain the exclusive property of Obsidian. The Software is protected under French law (Code de la propriété intellectuelle, Art. L.112-2 and L.122-6) and applicable international treaties. Any unauthorized reproduction, distribution or derivative work constitutes infringement and may result in civil and criminal prosecution.
Payment, Keys and Delivery
Payments are processed by our third-party payment providers (NOWPayments, PayPal). All prices are displayed in Euros, inclusive of applicable taxes. License keys are considered consumed upon digital delivery. Chargebacks or payment disputes without prior contact with Obsidian support result in: key invalidation, account termination, and reporting to fraud databases where applicable.
Subscriptions and Licenses
Obsidian sells lifetime licenses and time-limited licenses (1 day, 3 days, 1 week, 2 weeks, 1 month, 3 months). Duration stacking is supported: activating a new key on an active subscription extends the remaining time. Obsidian may revoke access in case of violation of these Terms.
Hardware Binding (HWID)
Each subscription is bound to a unique Hardware ID (HWID) generated from your device components. HWID resets can be granted by our support team to accommodate legitimate hardware changes. Any attempt to spoof or tamper with your HWID will result in immediate account termination.
Telemetry and Data Collection
By using the Software, you consent to the collection of technical data (hardware identifiers, system configuration, IP address, crash logs, usage statistics) used solely for license validation, fraud prevention and software improvement. Data processing complies with the General Data Protection Regulation (EU 2016/679) and the French Data Protection Act (Loi Informatique et Libertés). See our Privacy Policy for full details.
Limitation of Liability
To the fullest extent permitted by French law, Obsidian shall not be held liable for indirect damages, loss of revenue, loss of game accounts or in-game progress, or business interruption. In accordance with Article 1231-3 of the French Civil Code, liability is limited to foreseeable damages at the time of contract formation. Nothing in these Terms excludes or limits liability for fraud, gross negligence (faute lourde), bodily injury, or any liability that cannot be excluded under mandatory French law. These provisions do not affect your statutory consumer rights under the French Consumer Code.
Indemnification
You agree to indemnify, defend and hold harmless Obsidian against any claims, losses, liabilities, damages or expenses arising from your use of the Services, your violation of these Terms, or your violation of any third-party agreement. This indemnification applies to the fullest extent permitted by French law and does not affect your mandatory consumer rights.
Termination
Obsidian may terminate or suspend your license immediately if you breach any provision of these Terms, are identified as a Prohibited Party, if telemetry indicates misuse, or if fraud is detected. No refund will be granted following termination for cause, except where mandatory under French consumer law.
Governing Law and Jurisdiction
These Terms are governed exclusively by the laws of France. In the event of a dispute, the parties shall first seek an amicable resolution. Failing that, the competent courts of Paris shall have exclusive jurisdiction, subject to mandatory provisions of the French Consumer Code allowing consumers to bring proceedings before the courts of their place of residence (Art. R.631-3 of the Consumer Code).
Consumer Mediation
In accordance with Articles L.612-1 et seq. of the French Consumer Code, you may resort free of charge to a consumer mediator for the amicable resolution of any dispute. Before initiating mediation, you must first contact Obsidian support to attempt a direct resolution. The designated consumer mediation body and its contact details are available upon request through our Discord server.
Pre-Contractual Information
In accordance with Article L.111-1 of the French Consumer Code, the essential characteristics of the Services, their price, and the conditions of their execution are described on the product pages of the Obsidian website. By completing a purchase, you acknowledge having received all required pre-contractual information.
Modifications
Obsidian reserves the right to modify these Terms at any time. Substantial modifications will be notified via the Obsidian Discord server and on this page with a revised date. Continued use after notification constitutes acceptance. The version of these Terms in effect at the time of your purchase applies to that transaction.
